### Extended Producer Responsibility was launched in 2023, a new UK legislation requiring businesses to change the way they collect and report on the packaging they handle, in the hope of delivering a more circular economy. 

The main focus was the introduction of a new regime to reform and replace the UK's Packaging Recovery Note (PRN) system.

The changes are expected to cost UK producers around £1.7 billion each year, creating a strong incentive to reduce packaging and increase its recyclability.

that has had a significant reduction

on what we throw in general waste.

Producer responsibility itself

has been around in the UK for around

00:05:29:13 - 00:05:32:13

25 years and was first introduced

00:05:32:13 - 00:05:36:00

with the packaging regulations in 1997.

00:05:36:00 - 00:05:39:01

So it's not something that's

particularly new to us, although it does

00:05:39:01 - 00:05:42:17

seem to be new to quite a few people

out there in the in the real world,

00:05:44:06 - 00:05:47:03

along with with with packaging,

there's producer responsibility

00:05:47:03 - 00:05:51:01

regulations that cover wait, wait,

electrical electronic equipment,

00:05:51:21 - 00:05:54:03

portable batteries and the light vehicles

00:05:55:05 - 00:05:58:02

as part of the

the reason I say recent it's

00:05:58:02 - 00:06:00:15

almost five years old

now the resources and waste strategy,

00:06:01:07 - 00:06:04:02

one of the major tranches in

there was was around

00:06:04:10 - 00:06:09:02

bringing in further producer

responsibility and indeed the devolution

00:06:09:02 - 00:06:12:21

of extended producer

responsibility and packaging is the first

00:06:14:01 - 00:06:14:19

of those

00:06:14:19 - 00:06:20:06

regimes to to undergo the spotlight

and and be beefed up as opposed to

00:06:20:09 - 00:06:25:10

to put it mildly, the existing regulations

have been in place for a fair while

00:06:25:10 - 00:06:30:15

and was set up in a in a much different

marketplace than we see today

00:06:31:02 - 00:06:34:05

and and the recycling world

that we live in.

00:06:34:05 - 00:06:36:05

And the

00:06:36:05 - 00:06:41:02

the change to the regulations,

really trying to drive the stagnation

00:06:41:02 - 00:06:45:18

of recycling of a

certainly a packaging materials in the UK

00:06:46:09 - 00:06:48:12

and a lot of that from that

from a household point of view.

00:06:49:12 - 00:06:52:03

So extended producer responsibility

really widens

00:06:52:03 - 00:06:54:09

the scope of what we've seen in the past

00:06:55:17 - 00:06:58:22

and is is looking really to

to take on the full

00:06:58:22 - 00:07:02:19

net costs of recovery

for the IT within those regimes.

00:07:02:19 - 00:07:04:13

So whatever the cost is to

00:07:06:08 - 00:07:08:15

surface, particularly

the packaging in this circumstances

00:07:08:23 - 00:07:12:18

is the full

the full costs of of all packaging

00:07:12:22 - 00:07:17:10

that's collected and treated

and and recycled is placed back

00:07:17:10 - 00:07:21:04

on to those producers that are responsible

for pulling into the marketplace.

00:07:24:09 - 00:07:25:22

The new regulations

00:07:25:22 - 00:07:28:24

have changed the the landscape

00:07:28:24 - 00:07:32:19

quite significantly

and taken it away from a a

00:07:33:00 - 00:07:38:03

a low cost system to producers into this

into this format of recovery.

00:07:38:10 - 00:07:41:11

So one of the main changes

that we're going to see is is an increase

00:07:41:11 - 00:07:43:23

in the overall costs of of the system

itself.

00:07:45:05 - 00:07:47:15

Just the various

00:07:47:15 - 00:07:50:22

calculations around the

the system could be four

00:07:50:22 - 00:07:54:05

or five times more expensive

than than the previous system.

00:07:54:24 - 00:07:58:19

But that's all depends on on which markets

you look at to

00:07:58:24 - 00:08:01:04

to do the comparisons against.

00:08:01:04 - 00:08:05:13

It brings in a new type of producer,

so a smaller producer

00:08:05:13 - 00:08:07:05

as well as a large producer,

00:08:07:05 - 00:08:10:18

bringing down the thresholds

on which companies are obligated.

00:08:10:23 - 00:08:15:24

So that will bring in some new

you and new companies into the regime

00:08:16:05 - 00:08:20:04

and effectively expanding the reach of

of the regulations

00:08:20:04 - 00:08:23:19

to more and more companies to

to to pay their way during the system.

00:08:25:22 - 00:08:27:22

One also big change we're seeing is

00:08:27:22 - 00:08:32:02

the old system was based on a shared

responsibility approach.

00:08:32:08 - 00:08:35:22

So through the through the packaging

or supply chain, different picture

00:08:36:07 - 00:08:38:10

obligations on any piece of packaging

00:08:38:10 - 00:08:38:22

which is now

00:08:38:22 - 00:08:42:00

changed to a single point of compliance,

which is probably the major change

00:08:42:00 - 00:08:46:07

which is focusing the, the costs

onto brand holders and importers.

00:08:46:17 - 00:08:51:16

And some of the smaller players, such

as online marketplaces, have been brought

00:08:51:16 - 00:08:53:23

into the regulations and distributors

00:08:54:20 - 00:08:57:21

of of own branded packaging.

00:08:57:21 - 00:08:59:19

We're also seeing a big change in

00:08:59:19 - 00:09:03:16

in sort of the reporting side of things

and what producers have to report

00:09:04:13 - 00:09:07:02

going from an annual report to a twice

00:09:07:02 - 00:09:10:07

on the report, large producers

00:09:10:11 - 00:09:13:18

and also we're looking at

how we actually categorise the packaging.

00:09:13:18 - 00:09:18:08

So changing from from just it

being packaging to the split between

00:09:19:12 - 00:09:21:20

household and non-household packaging.

00:09:21:20 - 00:09:26:10

But this is really to to align

with the label to split the costs

00:09:26:10 - 00:09:29:10

between the local authorities

which collect a lot of household

00:09:29:11 - 00:09:32:18

packaging, waste and recycling

so that the household recycling stream

00:09:33:18 - 00:09:36:15

so produces a responsible

input in that sort of packaging.

00:09:36:15 - 00:09:38:10

The market will pick up the costs

00:09:38:10 - 00:09:40:19

from the local authority side of things

and then the

00:09:41:07 - 00:09:44:08

then all producers will pick up

the actual physical recycling costs

00:09:44:08 - 00:09:48:06

of such as the parent costs that we see

at the moment in the current system.

00:09:49:05 - 00:09:52:17

Does this further characterisations

of waste into reporting of the

00:09:52:17 - 00:09:56:10

waste, is it something that's currently

commonly thrown away in the

00:09:56:18 - 00:09:59:03

in the been on on the go packaging,

if you like

00:09:59:20 - 00:10:02:08

also alarming drinks containers

00:10:02:08 - 00:10:05:02

and also reporting

through the regulations itself

00:10:05:11 - 00:10:10:14

some of some of the backhaul in of waste

in and there's only mentioned earlier

00:10:10:14 - 00:10:15:00

around the supermarket

flexible film collections

00:10:15:15 - 00:10:18:24

they can be utilised to

to offset producers obligations as well.

00:10:19:22 - 00:10:23:22

We've got one additional

category in the mix as well

00:10:24:21 - 00:10:27:00

where we're spitting out fibre composite

00:10:27:00 - 00:10:29:19

packaging away from the carbon paper

previously

00:10:31:00 - 00:10:33:21

and we've also got to categorise

packaging by the by the level.

00:10:33:21 - 00:10:34:11

It's not.

00:10:34:11 - 00:10:36:17

So whether it's a primary piece

of packaging,

00:10:36:17 - 00:10:40:24

the packaging around the product

or or all the packaging with a secondary,

00:10:40:24 - 00:10:42:21

tertiary or, or shipment packaging

00:10:42:21 - 00:10:45:19

which is usually used to move

that primary packaging around.

00:10:46:20 - 00:10:50:13

Finally, there's an additional reporting

regime brought in

00:10:50:13 - 00:10:55:11

for the sellers of packaging as to where

they place that packaging on the market.

00:10:55:22 - 00:11:00:00

So, so retailers at such a

will will need to do separate reporting

00:11:00:22 - 00:11:05:08

around how and where

they place the packaging onto the market

00:11:05:11 - 00:11:10:23

to help with the setting

and the targets across England, Scotland,

00:11:10:23 - 00:11:14:21

Wales and Northern Ireland for recycling

of packaging waste moving forward.

00:11:17:12 - 00:11:19:14

Wow. Yes,

So much information to take on board there

and so much detail.

where we are

with the timeline of the legislation

and what's happened so far?

Yeah, sure.

And the the first set of regulations

that bring in the package

00:11:42:15 - 00:11:46:10

in April is a

is a data reporting standards instrument

00:11:46:10 - 00:11:49:17

that was laid in in in Westminster

00:11:50:01 - 00:11:52:17

earlier this year and came into force

00:11:52:17 - 00:11:56:01

for England, Scotland and Northern Ireland

on the on the 28th of secondary,

00:11:56:11 - 00:12:00:21

which effectively mandates producers

to collate

00:12:01:08 - 00:12:05:15

and report their packaging data from the

00:12:06:10 - 00:12:09:15

the 1st of March almost this year.

00:12:09:15 - 00:12:15:24

Or if they're able to to to to report that

from the 1st of January moving forward.

00:12:18:09 - 00:12:18:21

At the

00:12:18:21 - 00:12:21:21

same time we're starting to

to to look at April.

00:12:21:22 - 00:12:25:17

We're also finalising let's not forget the

the current period system so

00:12:26:12 - 00:12:29:01

people's final obligation

under the old system

00:12:29:13 - 00:12:33:10

and the reporting that has hopefully

been completed for most producers now

00:12:34:08 - 00:12:37:06

and that will run through

through this year with with with the for

00:12:37:08 - 00:12:40:24

the powering costs to go through

as as we've been used to for many years.

But that will then phase out experience

from the old system

00:12:45:01 - 00:12:46:16

that will exist in the new system

00:12:46:16 - 00:12:48:17

for part of the obligations,

as I mentioned earlier.

So what producers now

00:12:52:02 - 00:12:55:21

are in the middle of is trying to work out

how to translate their old

00:12:55:21 - 00:12:59:12

packaging data systems into the new ones

to report for EPR to cover

00:12:59:12 - 00:13:01:14

lots of those countries,

as I mentioned earlier.

00:13:01:14 - 00:13:04:08

So the first half of this year

really is around producers

00:13:04:17 - 00:13:07:09

getting that getting the data together

to be able to make a submission

00:13:07:18 - 00:13:10:12

in the second half of this

year by the 1st of October.

00:13:11:17 - 00:13:12:03

And that and

00:13:12:03 - 00:13:15:14

that process will roll on six monthly

for large producers

00:13:16:14 - 00:13:20:15

with the second half of the year

submitted by by the 1st of April.

Similar to how the annual data

has been submitted in the past.

Those two sets of data

will then be amalgamated by by Defra

00:13:29:17 - 00:13:34:23

and that will then move forward into

producing producers obligations for 2024.

And again, that that will roll forward

in the second half of the year.

We'll see the new online system

for all reporting

set up and producers will need to enrol

with, with the regulator to say

they're a producer

who that approved person is going to be.

Delegations authority

that they want to set up for that.

And as part of that process,

if they're a member of the packaging

00:14:03:01 - 00:14:07:02

compliance scheme, they can support them

with and take on the legal obligations

00:14:07:02 - 00:14:08:09

under the obligations

00:14:08:09 - 00:14:10:21

they'll be able to select

that compliance scheme on the register

00:14:11:08 - 00:14:12:21

or enrol themselves.

00:14:12:21 - 00:14:16:03

I've can't say register

because the rules don't say registration

at the moment

that they're going to come up

00:14:17:14 - 00:14:20:08

in the new regulations

as they come in for next year.

So producers enrol

and then they're able to report the data

00:14:24:21 - 00:14:28:06

either directly with the regulator

or through a compliance scheme as.

00:14:28:21 - 00:14:29:02

As we as

we move through the year into into 2024,

we see the the first set of reporting

requirements for a small producer.

So I mentioned that we've got large

and small producers,

the large producers are handling

00:14:46:10 - 00:14:49:15

over 50 tonnes of packaging this year

and turning over more than £2 million

00:14:49:15 - 00:14:52:20

as all with with the existing regulations.

00:14:54:03 - 00:14:58:24

But small producers are a smaller band

that are turning over

00:14:59:04 - 00:15:02:18

more than £1 million a year and handling

more than 20 volumes of packaging.

00:15:03:02 - 00:15:05:07

So lots more producers

come into the system.

00:15:05:17 - 00:15:09:06

They will need to understand the data,

the report that's for the whole year

00:15:09:14 - 00:15:12:21

in the first half of next year,

00:15:12:21 - 00:15:15:14

and then we will start seeing the fees

being

00:15:16:23 - 00:15:19:14

applied to two producers

00:15:19:20 - 00:15:23:03

probably into quarter two 2024.

What I will also say is the scheme is

going to be run by a scheme administrator,

00:15:31:08 - 00:15:32:19

which is due to

00:15:32:19 - 00:15:35:17

be appointed later on this year

00:15:36:15 - 00:15:37:21

and that probably covers us

00:15:37:21 - 00:15:40:21

to to work

to how we've got to go on a while longer.

I'd say, a collective of as staff

for a putting it collections

and packaging reforms at the moment.
